FAQs
Find answers to common questions about legal processes and what you can expect.
How long will property settlement take in the Gold Coast?
Timelines for property settlement can vary based on the factors involved in the case. The number of assets involved, and the level of cooperation that happens can shorten or lengthen the process. Our goal is to keep the process for both parties as short as possible, ideally avoiding long court proceedings.
What is the difference between a parenting plan and a consent order or custody order
While a parenting plan can help streamline the process, it is not legally binding. A parenting plan is a written agreement that requires the cooperation of both parties. If cooperation is unattainable, a consent order can be obtained and approved by the courts.
I want a divorce, but I don't want to go to court. Is that possible?
In many cases, yes. If the divorce application is administrative in nature and their are no disputes regarding children or property, parties may not need to go to court. Our lawyers will work with you to resolve familial issues outside of the court.
